Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and customers. By accessing or using the Service, or by placing an order, you agree to be bound by these Terms. If you disagree with any part of them, you may not use the Service.

2. Eligibility

You must be at least 18 years old, and able to form a legally binding contract, to purchase from the Service.

3. Accounts

When you create an account with us you must provide information that is accurate, complete and current. Failure to do so constitutes a breach of these Terms and may result in termination of your account.

You are responsible for safeguarding your password and for all activity under your account. You agree not to disclose your password to any third party, and to notify us immediately of any breach of security or unauthorised use of your account.

4. Products

We take care to display our products accurately. Colours and finishes may vary slightly between screens and between production batches, particularly on satin and printed fabrics. Sizes are given as guidance and we recommend consulting the size guide on each product page.

All products are subject to availability. We may limit quantities, and we may withdraw or amend any product without notice.

5. Prices, currency and taxes

All prices are displayed in United States Dollars (USD) unless otherwise stated at checkout, and are inclusive of any taxes we are required to charge. Prices may change at any time before you place an order.

If your payment card is denominated in another currency, your bank or card issuer will apply its own exchange rate and may charge a foreign transaction fee. These charges are set by your bank, not by us.

We ship on a delivered-duty-paid basis. Import duties, customs charges and local taxes are settled by us before delivery and are already reflected in the price you pay. You will not be asked to pay additional charges on delivery.

6. Orders and payment

Your order is an offer to buy. A contract is formed when we confirm dispatch of your order. We may decline or cancel an order — for example where a product is unavailable, where a pricing error has occurred, or where we suspect fraud — and we will refund any amount already charged.

We accept the payment methods shown at checkout. Payment is taken at the time of purchase. Card details are processed by our payment providers over encrypted connections; we do not store full card numbers on our systems.

7. Shipping and delivery

Orders are dispatched from our fulfilment facilities in Phuket (Thailand), Italy and the USA, and are shipped with tracking, delivered duty paid. Our usual dispatch and delivery window is 4–7 business days, and delivery estimates are indicative rather than guaranteed. Delays caused by carriers, customs or events outside our control are not our responsibility, though we will always assist in tracing a delayed parcel.

Risk in the goods passes to you on delivery.

8. Returns, exchanges and refunds

Returns, exchanges and refunds are governed by our Refund Policy, which forms part of these Terms and is available on our website. Please read it before ordering.

9. Intellectual property

The Service and its original content, features, functionality, designs, prints, photography and branding are and remain the exclusive property of Luminary Enterprise FZE and its licensors, and are protected by applicable intellectual property laws. You may not reproduce, distribute or create derivative works from our designs or content without our prior written permission.

10. Acceptable use

You agree not to use the Service for any unlawful purpose, to attempt to gain unauthorised access to our systems, to interfere with the operation of the Service, or to place fraudulent orders. We may refuse service, terminate accounts and cancel orders at our discretion where we believe this clause has been breached.

11. Links to other websites

The Service may contain links to third-party websites or services not owned or controlled by us. We have no control over, and assume no responsibility for, the content, privacy policies or practices of any third-party site. We advise you to read the terms and privacy policies of any third-party site you visit.

12. Disclaimer

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.

13. Limitation of liability

To the maximum extent permitted by law, our total liability to you in connection with any order shall not exceed the amount you paid for that order. We shall not be liable for indirect, incidental or consequential loss, including loss of profit or opportunity. Nothing in these Terms limits liability that cannot lawfully be limited.

14. Indemnity

You agree to indemnify and hold harmless Luminary Enterprise FZE, its officers and employees from any claim or demand arising out of your breach of these Terms or your violation of any law or the rights of a third party.

15. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination your right to use the Service ceases immediately. Provisions which by their nature should survive termination shall do so, including ownership provisions, warranty disclaimers, indemnity and limitations of liability.

16. Governing law

These Terms shall be governed and construed in accordance with the laws of the United Arab Emirates, without regard to conflict of law provisions. The courts of the Emirate of Sharjah, United Arab Emirates, shall have jurisdiction over any dispute arising from these Terms, subject to any mandatory consumer protection rights available to you in your country of residence.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision is held invalid or unenforceable, the remaining provisions remain in effect. These Terms constitute the entire agreement between us regarding the Service and supersede any prior agreements.

17. Changes to these Terms

We reserve the right to modify or replace these Terms at any time. Where a revision is material we will provide at least 30 days' notice before the new terms take effect. By continuing to use the Service after revisions become effective, you agree to be bound by the revised terms.
